Prenuptial Agreement Advice from a Notary
Advice on a prenuptial agreement can be provided by a notary. A prenuptial agreement must be notarized. So why not go straight to the notary? After all, they also provide advice.
It is true that notaries provide impartial advice. In other words, they do not advise individual spouses in a biased manner. The notary is obligated to remain neutral. If they realize that the spouses need legal counsel, they therefore usually refer them to a lawyer.
Notaries are also sometimes not particularly interested in prenuptial agreements — at least when they are expected to assist during the drafting phase. Why is that? Because of the fee schedule. Notaries can only charge the statutory rate for notarization, regardless of the time involved.
Of course, there are also notaries who take their role in prenuptial agreements particularly seriously. It is simply human nature to want to use one's time as profitably as possible.
Prenuptial Agreement Advice from a Lawyer
Lawyers, of course, also provide advice on prenuptial agreements. As mentioned, the notary often refers the spouses to lawyers so that each partner receives impartial advice.
Lawyers provide recommendations on which interests should be protected from the client's perspective in the event of separation or divorce.
Many family law attorneys take a more collaborative approach because they understand that marriage and family matters are not solely about money. They also involve conflict resolution, the best interests of the child, and preserving family unity.
Many couples want to work on their prenuptial agreement together in a cooperative atmosphere. One option is contract mediation, in which a mediator-lawyer contributes their wealth of experience (so-called advisory mediation).
Another option: one lawyer advises one spouse but listens to the other and also answers their questions — so-called mediation-style counseling. In our experience, this approach works very well in the vast majority of cases.
The Typical Process
- The spouses seek legal counsel. The lawyer drafts a proposal and sends it to the other spouse's lawyer.
- If the other spouse is not represented by a lawyer, a notary appointment can be arranged immediately.
- The notary may conduct a preliminary meeting — often when not both spouses are represented by a lawyer.
- The prenuptial agreement is notarized. The notary ensures that both partners understand the terms.
Precisely because a prenuptial agreement is a special document and marriage is protected by the Constitution, courts scrutinize these agreements closely. Is the prenuptial agreement highly one-sided? Was a weaker negotiating position exploited?
The mere fact that it is notarized merely satisfies the formal requirements. However, what is written in it is also crucial.
Why Drafting Your Own Documents Offers No Advantage
Every lawyer and notary is pleased when spouses are familiar with the key terms and have a general understanding of what they mean: the matrimonial property regime, spousal support, and pension rights equalization.
However, drafts prepared by spouses based on documents found online are usually unhelpful. In fact, the actual draft usually doesn't even factor into the cost of the prenuptial agreement.
It's much more about what actually needs to be addressed. Figuring that out, advising on it, and finally drafting the agreement accordingly — that is the focus of our prenuptial agreement consultation.
