Frequently Asked Questions
What you want to know
Divorce without a lawyer — what’s possible and what isn’t?
A “divorce without a lawyer” is not possible in Germany. The petition for divorce must be filed with the family court by a lawyer (§ 114 FamFG). However, if you want to avoid unnecessary escalation caused by lawyers, this wish can be granted — this is exactly where we come in.
How does a mutual divorce with just one lawyer work?
Are you and your ex in agreement about the divorce? Then you only need one lawyer (for the petitioner), a clear understanding of the consequences of the divorce, and a willingness to cooperate. This saves costs, reduces friction — and still ensures full legal certainty.
What are the advantages?
- Lower costs: Just one lawyer means only half the legal fees, which you can split
- Less friction: One point of contact, clear communication
- Transparency: Everyone involved knows what’s happening — at all times
Is there a “joint lawyer”?
No — a lawyer is not allowed to represent both spouses, even if there is agreement. That would constitute criminal breach of client confidentiality under § 356 StGB. What is possible, however, is a joint consultation in which both spouses participate — one as a client, the other as their still-spouse.
How much does a divorce by mutual consent cost?
The costs depend on the value of the proceedings, which is based on the spouses’ income and set by the court. We charge only the statutory minimum fee. If you split the costs, you save half the legal fees.
What happens if a dispute does arise?
We initially focus on amicable methods such as mediation and conciliation. The points of contention are resolved with the help of a neutral third party. We have had good experiences with colleagues who, like us, rely on a cooperative approach.
Is the “online divorce” really without a lawyer?
No — that’s misleading advertising. The truth is: you can hire us online and don’t have to come to our office to do so. The legal process (petition for divorce, pension rights equalization, divorce hearing) is always the same — whether online or not.
