1. divorce without a lawyer - what works and what doesn't

The idea of a “divorce without a lawyer” is not realistic in Germany. This is because the divorce petition must be submitted to the family court by a lawyer. This is provided for by law (§ 114 FamFG).

However, anyone who thinks that divorce without a lawyer means avoiding unnecessary escalation by lawyers can have this wish fulfilled.

This is exactly where we come in. We offer a solution for divorcing couples who want a streamlined divorce process that is as transparent as possible for both partners.

2. our approach: fair, clear, transparent.

If you have no disputes, we will file for divorce on behalf of one of you. However, if you so wish, the other partner can always be involved in the consultations and correspondence.

3. amicable divorce with just one lawyer: how it works

Have you and your ex agreed to divorce? Then all you need to do is:

  • A lawyer (for the applicant),
  • a clear understanding of the consequences of the divorce,
  • and a little willingness to cooperate.

In this constellation, you can go through the entire process with just one lawyer. This saves costs, reduces friction – and still allows full legal certainty.

  • Transparency and control: everyone involved knows what is happening – at all times
5. disadvantage of a divorce with only one lawyer

If there are no points of contention, there are no disadvantages to divorcing with only one lawyer. The only exception is that the divorce only becomes final one month after the court has pronounced it and both spouses cannot waive their right to appeal, which would make the divorce final immediately. However, this waiver of appeal costs the full fee of a lawyer for the divorce proceedings and is normally worthwhile emotionally at most.

6. no "common lawyer"

Again and again you hear: “We have a joint lawyer.”

Sounds good – but is legally wrong. A lawyer may not represent both spouses, even if there is agreement. That would be punishable party treason under § 356 StGB.

What is possible, however, is a joint consultation in which both spouses take part, one as the client and the other as the spouse who is to take part.

7. which points should there be agreement on?

If there is no dispute, no explicit agreement needs to be reached on any points. However, it is good if there is basic agreement on the following points:

  • Property settlement and distribution of household effects
  • Children and maintenance issues
8. special case of pension entitlements

If you do not have a marriage contract that excludes this, pension equalization will take place automatically in divorce proceedings.

Pension equalization involves the division of pension entitlements acquired during the marriage.

Automatic division is only omitted in the case of a short marriage of up to three years before the application for divorce or if pension equalization has been effectively excluded by notarial agreement.

Two lawyers are not needed for this either.

The spouses only have to state their insurance periods, the information and the division is then carried out by the court.

9 What happens if a dispute does arise?

Sometimes it only becomes apparent during the proceedings that not everything was clear after all.

In such cases, we initially rely on consensual dispute resolution methods such as mediation and arbitration. The issues in dispute are then resolved with the help of a neutral third party. We can continue to advise and represent “our” client, while the other spouse can consult their own lawyer. We have had good experiences with colleagues who, like us, rely on cooperative practice, i.e. who, like us, focus on cooperation rather than confrontation as long as this is possible.

10. what does a divorce by mutual consent with a lawyer cost?

The costs are based on the so-called value of the proceedings. This is generally based on the income of the spouses and is determined by the court.

We only charge the statutory minimum fee for our assistance with your amicable divorce. This means that no lawyer can offer cheaper representation in divorce proceedings.

If you share the costs, you will save half of the lawyer’s fees.

In addition, there are only the court fees, which are also calculated on the basis of the value of the proceedings. However, these are reduced in divorce proceedings compared to normal civil proceedings.

11. online divorce: fast, digital - but not without a lawyer

Some providers advertise with “divorce online without a lawyer” – but this is misleading.

Correct: You can also instruct us online without having to come to our office.

Otherwise, the so-called “online divorce” does not differ from the “normal divorce”. The procedure is always the same:
